Implementation of the Honduran Labor Cases System (SIHCAL)

In the ever-evolving landscape of labor management in Honduras, it is crucial to stay informed about the latest initiatives aimed at improving the interaction between capital and labor. In this context, we are delighted to share the specialized perspective of Lilian Cruz, our labor law consultant at Galindo & Asociados, regarding the recently approved Honduran Labor Cases System (SIHCAL).


On December 7, 2023, the Ministry of Labor and Social Security (SETRASS) took a significant step towards enhancing labor relations and administrative efficiency. Honduras has approved the Honduran Labor Cases System (SIHCAL), a groundbreaking tool supported by the Ministry of Labor and Social Security (SETRASS) and World Vision, with financing from the United States Department of Labor.




Constitutional Basis and International Commitment


The impetus for establishing SIHCAL is rooted in legal considerations and international commitments. Honduras' Constitution dictates that labor laws should be inspired by harmony between capital and labor, with the state overseeing compliance. Additionally, the No. 081 Convention on Labour Inspection, signed by Honduras, underscores the importance of maintaining a labor inspection system in industrial establishments.


Legal Framework: Labor Inspection Law


The pivotal Legislative Decree No. 178-2016, approving the Labor Inspection Law, regulates the Integrated Labor and Social Security Inspection System, ensuring compliance with legal provisions related to labor. A key aspect is the creation of the Simplified National Employers Registry System (SRNSP), overseen by the Ministry of Labor and Social Security.


However, it wasn't until January 19 that SIHCAL was established, thanks to funding from the United States Department of Labor through the Bright Futures project, involving SETRASS and World Vision.


Registration Mandate and Compliance Period


The Labor Inspection Law stipulates that all natural or legal persons engaged in labor activities must register in the SRNSP. The registration deadline is six months from the effective date of the Labor Inspection Law Regulation, as per Article 6. Those without access to the designated website can visit Regional and Local Offices of the Ministry of Labor to complete the registration.


Innovation: SIHCAL and Electronic Facilitation


SIHCAL not only simplifies the registration process but also introduces an advanced electronic linking and documentation scheme. This system, supported by a modern security system, allows businesses and citizens to streamline and properly document their labor cases. Moreover, it facilitates the registration of employers, providing a comprehensive tool to support SETRASS services.


Agreement for Labor Improvement


The recently approved agreement officially endorses SIHCAL as a supporting instrument for SETRASS services. It establishes a six-month period for employers and workplaces to complete registration in the SRNSP through the designated website. Those without online access can turn to regional and local offices of the Ministry of Labor for assistance.

Effective Date and Institutional Coordination


The agreement will take effect the day after its publication in the Official Gazette "La Gaceta." It also instructs the General Directorate of Labor Inspection to make the necessary adjustments and actions resulting from the agreement's entry into force.
